ARTICLE 1 / PARTIES
1.1 This Agreement is concluded between ENTER İSTANBUL GAYRİMEN.PAZ.DIŞ.TİC.LTD.ŞTİ. (Nevras Resort), located at Güldibi, Dilekli Cd. No:75, 54600 Sapanca/Sakarya, with the phone number 0850 500 0054 (hereinafter referred to as the “Seller”), and the customer who makes a reservation via the website, enters and confirms all personal information completely (hereinafter referred to as the “Customer”).
ARTICLE 2 / SUBJECT & SCOPE
2.1 This Distance Sales Agreement has been prepared in accordance with Law No. 6502 on the Protection of Consumers and the Distance Contracts Regulation.
2.2 The subject of the Agreement is the provision of accommodation services ordered electronically by the Customer through the Seller’s website, and the determination of the rights and obligations of the parties.
ARTICLE 3 / NATURE AND PRICE OF THE SERVICE
3.1 Prices subject to reservation are stated inclusive of VAT.
3.2 The contract price includes all services specified in the reservation. Extra services (cleaning, towel/sheet change, etc.) are charged separately.
3.3 For discounted or promotional products, a non-refundable cancellation fee is charged at the time of reservation. The remaining balance is collected on the check-in date.
3.4 Payment methods: bank transfer, EFT, credit card, or online payment system.
ARTICLE 4 / CHECK-IN AND CHECK-OUT
4.1 Check-in time: 15:00
4.2 Check-out time: 12:00
4.3 Early check-in/check-out requests must be notified to the Seller in advance. In case of early departure, no refund will be made.
ARTICLE 5 / VILLA CAPACITY
5.1 No guests exceeding the capacity specified in the reservation shall be accepted.
5.2 Requests for additional guests must be submitted to the Seller in writing, and if approved, an additional fee may be charged.
ARTICLE 6 / CLEANING, MAINTENANCE, AND EXTRA EXPENSES
6.1 Basic cleaning is included in daily, weekly, and monthly villa rental prices.
6.2 In weekly and long-term stays, towel/sheet changes are included.
6.3 Additional cleaning and changes are subject to extra charges.
6.4 Technical issues in the villa shall be resolved by the Seller; the Customer is responsible for providing necessary assistance.
ARTICLE 7 / PETS AND SMOKING
7.1 Pets are accepted in the villas.
7.2 Smoking is prohibited in indoor areas of the villas.
ARTICLE 8 / RESERVATION AND PAYMENT, CANCELLATION AND REFUND CONDITIONS
8.1 Reservation cancellations may be made via the website or through the Seller’s contact information.
8.2 For reservations made with a non-refundable cancellation fee, this fee is not refunded.
8.3 If the reservation is canceled 30 days or less prior to the check-in date, the paid amount is not refunded.
8.4 In case of cancellation due to reasons originating from the Seller, an alternative suitable villa is offered; if not accepted, the paid amount is refunded.
8.5 When payments are made by credit card, bank transfer, or EFT, refunds are processed according to the payment method used. Commission and banking fees may be deducted from the refund amount.
ARTICLE 9 / SELLER’S RESPONSIBILITIES
9.1 The Seller is obliged to deliver the villa on the agreed date and time, clean and ready for use.
9.2 The Seller is not responsible for accidents, illness, theft, or similar events occurring in the villa.
ARTICLE 10 / CUSTOMER’S RESPONSIBILITIES
10.1 The Customer is obliged to notify the Seller of all damages caused in the villa and to compensate for them.
10.2 Compliance with social and moral rules in and around the villa is mandatory.
10.3 Discomfort arising from technical and environmental conditions of the villa is under the responsibility of the Customer.
ARTICLE 11 / FORCE MAJEURE
11.1 War, strike, natural disaster, epidemic disease, public restrictions, etc. are considered force majeure.
11.2 In case of cancellations due to force majeure, paid amounts shall be refunded to the Customer without deductions.
ARTICLE 12 / RIGHT OF WITHDRAWAL
12.1 Pursuant to the Distance Contracts Regulation published in the Official Gazette dated November 27, 2014, and numbered 29188, the right of withdrawal cannot be exercised for accommodation services.
ARTICLE 13 / DISPUTES
13.1 Consumer Arbitration Committees and Consumer Courts shall be authorized in disputes arising from this Agreement.
13.2 In disputes between the parties, the courts and enforcement offices of Sakarya shall have jurisdiction.
By making a reservation for any villa offered by ENTER İSTANBUL GAYRİMEN.PAZ.DIŞ.TİC.LTD.ŞTİ. (Nevras Resort), the Customer shall be deemed to have accepted all the terms set forth in this Agreement.
